VIVAIA may delay issuance or delivery, suspend or deactivate an eGift or redemption code, restrict an account, deny or reverse a redemption, withhold or reverse V-Points, or reject, suspend, or cancel a related order where VIVAIA reasonably believes that:
* the eGift or V-Points were obtained, purchased, redeemed, or used through fraud, theft, unauthorized activity, deception, or another unlawful means;
* the payment used to purchase the eGift was declined, reversed, charged back, disputed, or otherwise not successfully received;
* the eGift program, V-Points program, purchase limits, promotional rules, or another VIVAIA policy has been abused, circumvented, or materially violated;
* an eGift, redemption code, account credit, or V-Points balance was issued or calculated in error; or
* action is necessary to comply with applicable law, a court order, a regulatory request, or a payment-service requirement.
VIVAIA may request additional information or verification reasonably necessary to review the transaction, establish ownership, confirm authorization, or prevent fraud. Where reasonably practicable and legally permitted, VIVAIA will provide notice of a restriction or reversal and an opportunity for the affected customer to provide relevant information.
Any suspension, reversal, cancellation, or recovery will be limited to the affected eGift, V-Points, transaction, order, or reasonably related account activity. VIVAIA will not reverse value validly acquired by a customer acting in good faith except where permitted or required by applicable law.
If V-Points obtained through an affected eGift have already been used, VIVAIA may, to the extent permitted by applicable law, cancel the related order, deduct the affected V-Points or equivalent value from the relevant account, offset the amount against a refund otherwise due, or seek recovery of the improperly obtained or used amount.
Nothing in this Section limits any statutory rights of a purchaser or recipient, including rights relating to unauthorized payments, billing errors, chargebacks, refunds, or fraud claims.
